Can H-4 spouses get an SSN? Without an EAD, with an EAD, and what to use instead

An H-4 spouse without an EAD generally cannot get a Social Security number, because the Social Security Administration only assigns numbers to noncitizens without work authorization for a narrow set of benefit-related reasons. As of November 2, 2026, SSA's operations manual says a driver's license, a bank account and taxes are not valid reasons. Once you have an H-4 EAD, you are work authorized and can apply. Until then, an ITIN from the IRS covers tax filing.

A Social Security number unlocks a lot in the United States: credit cards, some apartment applications, utilities, jobs. So H-4 spouses often ask: can I get one, and if not, what do I use?

As of November 2, 2026, here is what SSA's own rules say.

Key facts
  • SSA does not assign SSNs to noncitizens without work authorization unless they have a valid nonwork reason.
  • Valid nonwork reasons are tied to federal or state benefits that legally require an SSN.
  • A driver's license, a bank account and taxes are not valid nonwork reasons.
  • SSA lists H-4 spouses of H-1B workers without an EAD among nonimmigrants who may not work.
  • An H-4 EAD shows category C26 and is evidence of employment authorization.
  • Spouses who can't get an SSN use an ITIN for federal tax purposes.

Can H-4 spouses get an SSN without an EAD?

Generally no. SSA "will not assign an SSN to a noncitizen who is illegally residing in the U.S. or currently in lawful immigration status in the U.S., but does not have Department of Homeland Security (DHS) work authorization," unless the person "has a valid nonwork reason for an SSN" (SSA POMS RM 10211.600).

SSA's manual lists H-4 spouses of H-1B workers without an EAD among nonimmigrants who may not work. Its entry reads: "Spouse of H-1B and the spouse does not have an EAD" (SSA POMS RM 10211.420).

What counts as a valid nonwork reason?

Very little. SSA says "the only valid nonwork reasons" are a federal law that requires the SSN "to get a federally-funded benefit" you're otherwise entitled to, or a state or local law that requires it "to get public assistance benefits." You would also need "a letter from the appropriate government entity that explains the need for the SSN" (SSA POMS RM 10211.600).

The everyday reasons people give don't count. SSA's list of invalid reasons includes (SSA POMS RM 10211.615):

ReasonWhat SSA says
Driver's license"Not a 'valid nonwork reason' for assigning an SSN"
Bank account"SSA does not assign SSNs solely for this purpose"
State taxesSSA "does not assign SSNs for nonwork purposes solely for State tax purposes"
Federal taxesThe IRS assigns an ITIN to someone who "does not otherwise meet SSA's requirements for an SSN"

So applying at an SSA office as an H-4 spouse without an EAD usually ends in a refusal.

What changes when you get an H-4 EAD?

You become work authorized, and the door opens. SSA's manual lists the H-4 spouse of an H-1B with an EAD where "the I-766 shows 'C-26' under Category," and says the EAD "provides evidence of a non-immigrant's authorization to accept temporary employment in the United States" (SSA POMS RM 10211.420).

It also explains which document SSA relies on. In its example, someone with an older I-94 and a newer EAD applies, and "since the EAD is the more recently issued evidence, the EAD may be relied on as evidence of the alien's current lawful alien status."

Your checklist
  • Bring your H-4 EAD, passport and I-94 to SSA.
  • Bring your marriage certificate if your name differs across documents.
  • Apply after the EAD card arrives, not on the approval notice alone.

Our guide to the H-4 EAD explains who qualifies: generally spouses of H-1B workers with an approved I-140, or with H-1B time extended under AC21. The I-765 instructions say you must submit "documentation establishing either your spouse is the beneficiary of an approved Form I-140" or received H-1B status under AC21 sections 106(a) and (b) (USCIS, Instructions for Form I-765).

What if your H-4 EAD expires?

Your number stays yours, but the right to work doesn't. The IRS says to use your SSN for taxes "even if your SSN does not authorize employment or if you have been issued an SSN that authorizes employment and you lose your employment authorization" (IRS, Instructions for Form W-7).

Renew the EAD early. Automatic extensions now apply only to a "Renewal application filed before October 30, 2025" under the regulation's heading (8 CFR 274a.13(d), eCFR). Our guide to the end of automatic EAD extensions explains what that means for H-4 spouses.

What do you use instead of an SSN?

For taxes, an ITIN. The IRS says an ITIN is "a 9-digit number the IRS issues if you need a U.S. taxpayer identification number for federal tax purposes, but you aren't eligible for a Social Security number (SSN)" (IRS, Individual Taxpayer Identification Number). A spouse can get one if they "can be claimed for an allowable tax benefit" or "file your own tax return," and filing jointly is one such benefit. Our guide to taxes for H-1B workers and green card holders covers the joint-return choice. Our guide to the ITIN for H-4 spouses walks through Form W-7.

The ITIN is limited. "An ITIN doesn't entitle you to social security benefits and doesn't change your immigration status or your right to work in the United States" (IRS, Instructions for Form W-7).

For a driver's license, the REAL ID rules let someone with a passport, visa and I-94 "present an SSN or demonstrate non-work authorized status" instead (6 CFR 37.11(e)(3), eCFR). For banking, SSA notes that a bank can take "either the SSN assigned to the individual, when applicable, or an ITIN" (SSA POMS RM 10211.615). Our guides to the H-4 driver's license and opening a bank account on H-4 cover both in detail.

What this means for you

Your checklist
  • Without an EAD, don't expect SSA to issue you a number.
  • A license, bank account or tax return isn't a valid reason.
  • Once you have an H-4 EAD, apply to SSA with the card.
  • Use an ITIN for federal taxes until then.
  • Renew your EAD early, since the automatic extension mostly ended.

Frequently asked questions

Can an H-4 spouse get an SSN without an EAD?

Generally no. SSA will not assign an SSN to a noncitizen who is in lawful status but has no work authorization, unless there is a valid nonwork reason. Those reasons are tied to federal or state benefits that legally require an SSN. A driver's license, a bank account and taxes don't qualify. Most H-4 spouses without an EAD therefore can't get one.

How do I get an SSN after my H-4 EAD is approved?

Apply to the Social Security Administration with your EAD, which shows category C26, along with your passport and I-94. SSA's manual treats the EAD as evidence of employment authorization, and when you have both an I-94 and a newer EAD, the EAD can be relied on as evidence of your current status. Check SSA's website for how to apply in your area.

Do I need an SSN to file taxes on H-4?

No. If you aren't eligible for an SSN and you have a federal tax purpose, such as filing a joint return with your H-1B spouse, you apply for an ITIN from the IRS with Form W-7. The ITIN is for federal tax purposes only and doesn't change your immigration status or give you the right to work.

Will my SSN stop working if my H-4 EAD expires?

Your SSN stays yours. The IRS says to use your SSN to file taxes even if it doesn't authorize employment or if you lose your employment authorization. But the number alone doesn't let you work. You need a valid EAD, so file renewals early, since most renewals filed since October 30, 2025 get no automatic extension.

Can an H-4 spouse open a bank account without an SSN?

Usually yes. SSA's manual notes that a taxpayer number for banking can be an SSN or an ITIN, and that people in the U.S. for less than six months can give the bank Form W-8 instead. SSA does not assign SSNs just for banking, so ask the bank which documents it accepts.
