Quick answer

What can I do if I lost the H-1B lottery?

You still have options. The O-1A work visa has no lottery. EB-1A and EB-2 NIW let you file for a green card yourself. Universities and some nonprofits and research groups can hire on an H-1B with no lottery. With a STEM degree on OPT, you may get a 24-month extension. Your employer can also register you again next year.

  • O-1A: no lottery, but an employer or agent must file.
  • EB-1A and NIW: no employer needed, but they are green cards, not a quick work permit.
  • Cap-exempt H-1B: no lottery at qualifying employers.
  • Check your status end date and OPT unemployment days today.

What to do this week

Small steps now keep more doors open later.

  1. Write down your deadlines

    Day 1

Note your status end date. On H-1B, L-1 or O-1, a grace period of up to 60 days may apply after a job ends (8 CFR 214.1(l)(2)). On OPT, count unemployment days. The limit is 90, or 150 in total with a STEM extension (8 CFR 214.2(f)(10)(ii)(E)).

  2. Check STEM OPT with your DSO

    Day 2

Degree on the DHS STEM list? Employer in E-Verify? Ask your school’s DSO about the 24-month extension.

  3. Ask your employer four questions

    Day 3

Will you register me again next year? Would you file an O-1? Do you have an office abroad? Do you work with a cap-exempt partner?

  4. Check your citizenship

    Day 3

Australian nationals may have E-3. Canadian or Mexican citizens may have TN. See the full guide for more.

  5. See where you stand for O-1A, EB-1A and NIW

    Day 4

Frank’s free evaluation checks your resume against each criterion. No account or card.

  6. Talk to an attorney

FAQ

Questions people ask

Common options: O-1A, an EB-1A or NIW petition, a cap-exempt H-1B job, STEM OPT, L-1, E-3 or TN. Which fits depends on your situation.

No. The O-1 has no lottery or yearly cap. A US employer or US agent must file it. You need a major award or 3 of 8 criteria.

Universities, their affiliated or related nonprofits, nonprofit research organizations and government research organizations. Jobs with them do not go through the lottery.

Yes, until your OPT ends, as long as you stay within the unemployment limits. With a DHS-listed STEM degree and an E-Verify employer, you may apply for a 24-month extension.

Yes. EB-1A and EB-2 NIW let you file for yourself. A green card petition does not by itself let you work. You usually need another status in the meantime. See green card without an employer sponsor.

It depends. O-1 has no lottery but a high evidence bar. H-1B is easier to qualify for but needs selection. Compare them in O-1 or H-1B.
