Quick answer
How long does EB-1A take?
As of October 2026, EB-1A time depends on four stages. You build evidence, USCIS decides Form I-140, you wait for a visa number, then you take the green card step. With premium processing, USCIS must act on the I-140 within 15 business days. In the September 2026 bulletin, most countries had no EB-1 wait.
- Premium processing (Form I-907): USCIS acts on an EB-1A I-140 within 15 business days (USCIS).
- “Acts” means an approval, a denial, an RFE, a NOID or a fraud investigation. It is not a promise of approval.
- September 2026 bulletin: EB-1 was current for every country except mainland China and India.
Timeline
EB-1A timeline by stage
Each stage has its own clock. Premium processing only speeds up stage 2.
| Stage | What happens | How long |
|---|---|---|
| 1. Prepare the case | You gather proof for a major award or at least 3 of 10 criteria (8 CFR 204.5(h)(3)), plus letters and the petition. | Depends on your evidence. As practical guidance, many Frank users build evidence over several months. |
| 2. I-140 decision, regular | USCIS reviews your Form I-140. | Varies. Check the USCIS tool. |
| 2. I-140 decision, premium | You add Form I-907. USCIS must approve, deny, or send an RFE or NOID. | 15 business days |
| 3. Wait for a visa number | Your priority date (the date your I-140 is properly filed) must be current in the Visa Bulletin. | September 2026: no wait for most countries. Cutoff July 1, 2023 for mainland China and October 15, 2022 for India. |
| 4a. Form I-485 in the US | Biometrics, an interview if USCIS decides one is needed, then a decision. | Varies. Check the USCIS tool. |
| 4b. Consular processing abroad | Immigrant visa interview at a US embassy or consulate. | Varies by consulate. |
If a visa number is available when you file, you can file Form I-485 with your I-140 (USCIS concurrent filing; 8 CFR 245.2(a)(2)(i)(B)). Then stages 2 to 4 overlap. Visa wait figures are the Final Action Dates in the September 2026 Visa Bulletin. USCIS said to use that chart that month. A new fiscal year starts October 1, so check the current month on our Visa Bulletin page. Priority date: 8 CFR 204.5(d).

How to check the live USCIS processing time
Regular processing times change often, so we do not quote them. Here is how to see today’s figure.
-
Open the USCIS tool
Go to USCIS Check Case Processing Times. It is free and needs no login.
-
Pick your form
Choose Form I-140 for the petition. Choose Form I-485 for the green card step inside the US.
-
Pick your category and office
Choose the category that matches your case, such as extraordinary ability. Then pick the service center or field office on your receipt notice (Form I-797).
-
Read it as a guide
The time shown is an estimate and it changes over time. It is not a promise for your case. Check again before you make plans.
Delays
What slows an EB-1A case down?
-
A Request for Evidence (RFE)
USCIS may ask for more proof. An RFE gives you no more than 12 weeks to answer. A notice of intent to deny (NOID) gives no more than 30 days. Extra time may not be granted (8 CFR 103.2(b)(8)(iv)). With premium processing, the clock stops. A new 15 business day period starts when USCIS gets your answer (USCIS). See how to respond to an RFE.
-
Missing required evidence at filing
If required initial evidence is missing, the USCIS processing clock starts over when it arrives (8 CFR 103.2(b)(10)(i)). A complete filing avoids this.
-
Visa Bulletin retrogression
Cutoff dates can move backward when visa numbers run low. A date that is current one month may not be current the next (USCIS). Read more on EB-1 priority dates and retrogression.
Premium processing does not make a weak case stronger. See what I-140 premium processing guarantees.
While you wait
Can I work or travel while my green card is pending?
This depends on Form I-485, the green card application you file inside the US. Your attorney checks your own status first.
-
Work
With a pending Form I-485, you can apply for a work permit (EAD) on Form I-765 (USCIS; 8 CFR 274a.12(c)(9)). Details: EAD while your I-485 is pending.
-
Travel
Leaving the US with a pending I-485 is treated as abandoning it. The exception: you got advance parole first and were inspected and paroled on return (8 CFR 245.2(a)(4)(ii)). You ask for advance parole on Form I-131 (USCIS). People in lawful H-1 or L-1 status have a separate rule with its own conditions. If you have ever been in the US unlawfully, ask an attorney before you travel: since August 13, 2026, leaving on advance parole can count as a departure for the 3- and 10-year bars (USCIS). Details: travel while your I-485 is pending.

Not in the September 2026 bulletin. The Final Action Date was July 1, 2023 for mainland China and October 15, 2022 for India. All other countries were current. Dates change every month.
