H-4 driver's license: documents, the SSN problem, and how long it lasts

H-4 spouses can get a driver's license, usually a limited-term REAL ID that ends with their authorized stay. As of November 2, 2026, the REAL ID regulation lets someone who shows a foreign passport, U.S. visa and I-94 either present an SSN or demonstrate non-work authorized status, so an H-4 spouse without an EAD is not shut out. But the Social Security Administration will not issue an SSN just for a license, so ask your DMV how it handles applicants who are not eligible for one.

You moved to the US on H-4, your spouse has a license, and you want one too. Then the DMV asks for your Social Security number, and you don't have one. Is that the end of it?

No. As of November 2, 2026, here is how the federal rules treat H-4 spouses, and what to bring.

Key facts
  • H-4 is a nonimmigrant status, so H-4 spouses qualify for a limited-term REAL ID.
  • The card cannot last longer than the authorized stay on the I-94.
  • With a passport, visa and I-94, you must present an SSN or demonstrate non-work authorized status.
  • SSA says a driver's license is not a valid nonwork reason for assigning an SSN.
  • An H-4 EAD is an accepted identity document and makes you eligible for an SSN.
  • Limited-term licenses must be renewed in person.

Can H-4 spouses get a driver's license?

Yes. Under the REAL ID regulation, anyone who "has a valid nonimmigrant status in the United States" is in temporary lawful status (6 CFR 37.3, eCFR). States may issue those applicants a limited-term card, but not "for a time period longer than the expiration of the applicant's authorized stay in the United States" (6 CFR 37.21, eCFR).

So an H-4 license usually ends on the date on your I-94. Since H-4 status depends on your spouse's H-1B, your dates often move together.

What if you don't have an SSN?

The rule has a route for you. Most applicants must show a Social Security card or a document with the number on it. But the regulation adds that someone who presents the foreign passport, visa and I-94 combination "must present an SSN or demonstrate non-work authorized status" (6 CFR 37.11(e)(3), eCFR).

An H-4 spouse without an EAD is not authorized to work, so this is the clause that applies. How you demonstrate it is up to your state, so check your DMV's page for what it accepts before you go.

Don't expect SSA to issue a number for this. SSA's operations manual says "a driver's license is not a 'valid nonwork reason' for assigning an SSN, and SSA does not assign an SSN for this purpose" (SSA POMS RM 10211.615). More generally, SSA "will not assign an SSN to a noncitizen" who is in lawful status but has no work authorization, "unless the alien has a valid nonwork reason" (SSA POMS RM 10211.600).

Which documents should you bring?

The regulation's identity document for most H-4 spouses is an "Unexpired foreign passport with a valid, unexpired U.S. visa affixed accompanied by the approved I-94 form documenting the applicant's most recent admittance" (6 CFR 37.11(c)). Because that document doesn't prove status by itself, you also need DHS documents showing your status.

Your checklist
  • Passport with your H-4 visa.
  • Your I-94, printed from CBP's website.
  • Your H-4 approval notice, if you changed or extended status in the U.S.
  • Your spouse's H-1B approval notice.
  • Your marriage certificate, to link your status to theirs.
  • Your SSN, or the proof your state accepts that you aren't eligible.
  • Two proofs of your home address.

TSA's REAL ID guidance says lawful status "must be verified through Systematic Alien Verification for Entitlements (SAVE)," the USCIS service DMVs use (TSA, REAL ID Frequently Asked Questions). Proof of address can be harder for a dependent spouse if bills are in your spouse's name, so ask your DMV which documents it takes in that situation. Our guide to REAL ID on H-1B, H-4 or an EAD covers the identity documents for each visa type.

What if your H-4 visa stamp has expired?

Watch the wording. The passport route requires a "valid, unexpired U.S. visa." If you entered on an H-4 stamp that has since expired, or you changed to H-4 inside the U.S. and never had a stamp, that route may not fit. Our guide to an expired visa with a valid I-94 explains why you can still be in status.

An H-4 EAD helps here. The regulation separately lists an "Unexpired employment authorization document (EAD) issued by DHS, Form I-766" as an identity document. Otherwise, ask your DMV what it accepts with your I-797 approval notice.

Does an H-4 EAD make it easier?

Yes, in two ways. The EAD is an identity document on its own, and it makes you work authorized, which means you can apply for an SSN. Our guide to the H-4 EAD covers who qualifies. Our guide to getting an SSN on H-4 explains the Social Security side.

The catch is the dates. Your license may then follow the EAD or your I-94, whichever your state uses, and renewals of H-4 EADs filed on or after October 30, 2025 no longer get the old automatic extension (8 CFR 274a.13(d), eCFR). Our guide to the end of automatic EAD extensions explains the change.

How does renewal work?

In person. TSA's guidance says limited-term licenses "need to be renewed in person and upon presentation and verification of valid documentary evidence that the temporary lawful status is still in effect." When your spouse's H-1B extension is approved, your H-4 extension approval and new I-94 are what you bring.

If the DMV can't confirm your status, track the check with SAVE CaseCheck using your date of birth and your I-94 or receipt number (USCIS, SAVE CaseCheck).

What this means for you

Your checklist
  • H-4 spouses can get a limited-term license tied to the I-94.
  • No SSN? The REAL ID rule lets you show non-work authorized status instead.
  • SSA won't give you a number just for a license.
  • An expired H-4 stamp may complicate the passport route, so an EAD helps.
  • Renew in person with your newest approval notice.

Where to start

H-4 status depends entirely on your spouse's case. If either of you has a strong professional record, a self-petition may move the family forward faster. Frequently asked questions

Can H-4 visa holders get a driver's license?

Yes. H-4 is a valid nonimmigrant status, which the REAL ID rules treat as temporary lawful status. You can get a limited-term REAL ID that cannot last longer than the authorized stay on your I-94. The DMV verifies your status through USCIS's SAVE system. States may add their own rules, so check your DMV's page first.

Do I need an SSN to get a driver's license on H-4?

Not always. The REAL ID regulation says someone presenting a foreign passport with a valid visa and I-94 must present an SSN or demonstrate non-work authorized status. H-4 spouses without an EAD are not work authorized, so the rule gives them a route. What proof your state accepts for that is up to the state.

Will the Social Security office give me an SSN for a driver's license?

No. The Social Security Administration's operations manual says a driver's license is not a valid nonwork reason for assigning an SSN, and SSA does not assign an SSN for that purpose. If you have an H-4 EAD, you are work authorized and can apply for an SSN on that basis instead.

Which documents should an H-4 spouse bring to the DMV?

Bring your passport with a valid H-4 visa, your I-94, your H-4 approval notice if you changed status in the U.S., your spouse's H-1B approval notice, your marriage certificate, two proofs of address, and either your SSN or what your state accepts instead. If you have an H-4 EAD, bring it too.

My H-4 visa stamp expired. Can I still get a license?

The regulation's passport route lists a valid, unexpired U.S. visa with the I-94. If your stamp expired but you are in status through an extension approved in the U.S., an H-4 EAD is the cleaner identity document if you have one. Otherwise, ask your DMV what it accepts with your I-797 approval notice.
