EB-1A vs EB-2 NIW

EB-1A vs EB-2 NIW: which green card should you file?

Both let you file for yourself, with no employer and no labor certification. EB-1A has a higher bar and its own visa line. NIW has a lower bar but needs EB-2 eligibility first.

Quick answer

EB-1A or EB-2 NIW: how do I choose?

EB-1A fits people at the very top of their field: a major award, or 3 of 10 criteria plus sustained acclaim. EB-2 NIW fits people with an advanced degree or exceptional ability whose work has national importance. As of October 2026, premium processing takes 15 business days for EB-1A and 45 for NIW.

  • Neither needs an employer, a job offer or a labor certification.
  • EB-1A has the higher bar. NIW needs EB-2 eligibility plus the three Dhanasar prongs.
  • EB-1A uses the EB-1 line, NIW the EB-2 line. In September 2026, EB-1 was shorter for India and China.
  • You can file both. If both are approved, you keep the earliest priority date.
  • A partner-firm attorney confirms which one fits your record.

Decide

Which one should you file?

Use this as a starting point. A partner-firm attorney makes the call with you.

  1. File EB-1A if...

You can show a major award, or at least 3 of the 10 criteria. Examples: judging others’ work, press about you, major contributions or high pay. Your field knows your name. It helps most if you were born in a country with a long EB-2 line, such as India or China.

  2. File NIW if...

You have a master’s or PhD (or a bachelor’s plus 5 years of progressive experience). You have a clear plan for work with national importance. Your record is solid but you are not yet at the top of your field. See the three NIW prongs.

  3. File both if...

Your record is strong for NIW and close to the EB-1A bar. Your country has a long EB-2 line, so a later EB-1A approval could move you to a faster line. Or you want a hedge in case one is denied.

  4. Wait and build if...

You meet fewer than 3 EB-1A criteria and have no clear NIW endeavor yet. An O-1 visa may help you work in the US while you build.

Both at once

Can you file EB-1A and NIW at the same time?

Yes. Running both is a common strategy. These rules shape how it works. More in filing two petitions.

  1. You keep the earliest priority date

If you have several approved EB-1, EB-2 or EB-3 petitions, you get the earliest priority date (8 CFR 204.5(e)(1)).

  2. Only approval counts

Only an approved petition passes its priority date to a later one. So a second filing helps only if it is approved (8 CFR 204.5(e)(1)).

  3. Do not file the same petition twice

USCIS may reject “materially identical” requests filed while one is pending (8 CFR 103.2(a)(7)(iv)). Your attorney checks how this applies to your pair.

  4. Tell one story

Both petitions sit in the same file. Describe your field, roles and dates the same way in each.

  5. Budget for two

Two I-140 filing fees, two Asylum Program Fees, and two legal fees.

FAQ

Questions people ask

Usually, yes. EB-1A asks for sustained acclaim at the very top of your field. NIW asks for an advanced degree or exceptional ability plus work of national importance. Under the Kazarian two-step review, meeting 3 EB-1A criteria is only step one.

With premium processing, USCIS acts on an EB-1A I-140 within 15 business days and an NIW within 45. If it misses that, it refunds the premium fee. After approval, the wait for a visa number depends on your country. Check the USCIS processing times for cases without premium.

Yes. A master’s degree counts. So does a bachelor’s plus 5 years of progressive work in your field. You can also qualify through exceptional ability, which needs at least 3 of 6 criteria.

Yes. You can file EB-1A later. If your NIW was approved, the later petition can generally keep the NIW priority date. This helps most if you were born in India or China.

USCIS fees are the same. As of October 2026, Form I-140 costs $715 by mail or $665 online. Self-petitioners add a $300 Asylum Program Fee. Our partner-firm legal fees start at $8,995 for EB-1A and $7,995 for NIW.

No. You can file either petition yourself. A partner-firm attorney can tell you if telling your employer matters in your case.
