Quick answer

Which visa or green card fits a software engineer?

Engineers usually compare four routes: O-1A, EB-1A, EB-2 NIW and H-1B. EB-1A has no degree requirement in 8 CFR 204.5(h). You need a major award or evidence for 3 of 10 criteria. EB-1A and NIW let you file for yourself, with no employer.

  • No PhD, paper or citation is required for EB-1A.
  • O-1A skips the H-1B lottery, but an employer or agent must file.
  • NIW needs an advanced degree or exceptional ability first.
  • Practical guidance: open source, judging, critical role and pay are common engineer evidence.

Sources: 8 CFR 204.5(h)(3) and the USCIS Policy Manual, Vol. 6, Part F, Ch. 2. The manual says “it is not the title of the person’s role” but performance in it that makes a role critical. It also says funded, patented or published work does not necessarily show major significance on its own.

Get started

Where engineers usually start

  1. Audit your record

List reviews, talks, awards, press, adoption numbers and pay. Many engineers already have one or two criteria.

  2. Pick 2 or 3 criteria you control

Judging, critical role and high salary are often within reach. See which criteria to build first.

  3. Collect outside proof of impact

Adoption by unrelated companies, licensing, and letters from people outside your team carry more weight than your own description.

  4. Choose the route with an attorney

O-1A now and a green card later is a common plan. A partner-firm attorney decides what fits your case.

FAQ

Questions people ask

Yes. 8 CFR 204.5(h) has no degree requirement. You need a major award or 3 of 10 criteria. Then USCIS weighs your whole record.

Open source is not its own criterion. It is usually argued as an original contribution of major significance. That needs proof that others adopted and rely on it.

Judging the work of others in your field can count, such as conference paper review or competition judging. You need the request and proof you actually completed it. Practical guidance: routine code review at your job is unlikely to be enough on its own.

It can meet one criterion if your pay is high compared with others in your field and location. You still need at least two more criteria for EB-1A.

Practical guidance: many engineers use O-1A to work now, then file EB-1A or NIW. The evidence overlaps, but each petition is judged on its own.

EB-1A has no employer requirement, so you can file it for yourself while you work on another visa. Ask a partner-firm attorney how it fits your current status.
