Quick answer
Which visa or green card fits an engineer?
Engineers usually compare EB-2 NIW, EB-1A, O-1A, H-1B and PERM. The NIW suits engineers with a master’s degree, or a bachelor’s plus 5 years of progressive experience, whose work has national importance. EB-1A and O-1A need a major award or evidence for several criteria. H-1B and PERM need an employer.
- NIW and EB-1A let you file for yourself, with no employer.
- Matter of Dhanasar, the NIW test, involved an aerospace engineering researcher.
- A patent alone may show originality, not major significance.
- No profession qualifies automatically. Your evidence decides.

| Route | What you get | Fit for engineers | Key hurdle | Our legal fee from |
|---|---|---|---|---|
| EB-2 NIW | Green card, you can file for yourself | Advanced degree, work in energy, infrastructure, defense, semiconductors or similar areas of national importance | Advanced degree or exceptional ability, plus the 3-part Dhanasar test | $7,995 |
| EB-1A | Green card, you can file for yourself | Strong, documented record: patents others use, papers, judging, a critical role | A major award or 3 of 10 criteria, then a review of your whole record | $8,995 |
| O-1A | Work visa, up to 3 years at first | Strong record and you need to work soon, with no lottery | A US employer or agent must file. A major award or 3 of 8 criteria, plus an advisory opinion. | $6,999 flat |
| H-1B | Work visa | An employer will sponsor you | Cap-subject jobs go through a yearly selection weighted by wage level | Quoted on request |
| EB-2 PERM | Green card through your employer | Your employer will sponsor a permanent role | Your employer needs a Department of Labor labor certification first | $7,995 |

Your evidence
Typical engineering evidence, by criterion
Practical guidance on where engineering work usually fits. What counts in your case is decided on your documents.
| What engineers often have | Criterion it may support | What it must show |
|---|---|---|
| Patents that others license, cite or build into products | EB-1A and O-1A original contributions; NIW well positioned | Major significance to the field. A patent alone may show originality but not, on its own, major significance. |
| Work on standards bodies (for example, drafting or reviewing technical standards) | Original contributions if your proposal was adopted; judging if you reviewed others’ submissions | Proof of your specific role and its effect. Ordinary membership usually is not enough for the membership criterion. |
| Journal and conference papers | EB-1A and O-1A scholarly articles | You are a listed author, in professional or major trade publications |
| Peer review for journals or conferences | EB-1A and O-1A judging | You were asked and actually completed the review |
| Leading a key program, product or system at a respected company or lab | EB-1A leading or critical role; O-1A critical or essential capacity | Your performance in the role, not your title, and the organization’s distinguished reputation |
| Government or industry funding, and letters from outside experts | NIW prongs 1 and 2 | National importance of the endeavor, and that you are well positioned to advance it |
Sources: 8 CFR 204.5(h)(3) and the Policy Manual, Vol. 6, Part F, Ch. 2 and Ch. 5. The manual says funded, patented or published work “will not necessarily establish, on its own” major significance. See original contributions.
Why Dhanasar matters to engineers
The NIW test came from an aerospace engineering case
In Matter of Dhanasar, 26 I&N Dec. 884 (AAO 2016), the petitioner was a researcher and educator in aerospace engineering. He held master’s degrees in mechanical engineering and applied physics and a Ph.D. in engineering. His research focused on hypersonic propulsion and computational fluid dynamics. The AAO approved his NIW based on that research.
The same decision found his STEM teaching plans had merit but did not show national importance. Practical guidance: define your proposed endeavor around the work with the broadest effect. Read Matter of Dhanasar explained.

Where engineers usually start
-
Check the NIW threshold
Do you have a master’s or higher, or a bachelor’s plus 5 years of progressive experience in the specialty? If not, look at exceptional ability, EB-1A or O-1A.
-
Write your proposed endeavor
Describe the specific work you will do in the US and why it matters nationally. See NIW for STEM and entrepreneurs.
-
Collect outside proof of impact
Licensing, citations, adoption of your designs or standards, and letters from people outside your employer carry the most weight.
-
Keep employer routes open
If your employer will sponsor you, H-1B and PERM can run alongside a self-filed NIW or EB-1A.
-
Choose the route with an attorney
A partner-firm attorney decides what fits your case before anything is filed.
FAQ
Questions people ask
Yes, if you meet the advanced degree or exceptional ability threshold and the 3-part Dhanasar test. The field matters less than showing your specific endeavor has national importance.
Patents can support the original contributions criterion. USCIS says a patent may show originality but will not necessarily, on its own, show major significance. Proof that others use your invention helps.
Practical guidance: it can help when you show your specific role, such as an adopted proposal or reviewing others’ submissions. Open membership in a standards body is unlikely to meet the membership criterion on its own.
No. A master’s degree, or a bachelor’s plus 5 years of progressive experience in the specialty, counts as an advanced degree under 8 CFR 204.5(k)(2).
PERM needs your employer and a labor certification. The NIW waives the job offer and labor certification, so you can file for yourself. Many engineers weigh both with an attorney.
O-1A, NIW and EB-1A have no lottery. See lost the H-1B lottery for options.
