Why it matters for you

Why Form I-485 matters

  1. Timing depends on the Visa Bulletin

A visa must be immediately available to file. Check the Visa Bulletin page. (8 CFR 245.2(a)(2)(i)(A))

  2. Filing early can help

If a visa is available, you can file Form I-485 at the same time as Form I-140. (8 CFR 245.2(a)(2)(i)(B))

  3. You can work while you wait

A pending I-485 lets you apply for a work permit. (8 CFR 274a.12(c)(9))

  4. Travel carefully

In most cases, leaving the US without advance parole counts as abandoning your application. (8 CFR 245.2(a)(4)(ii)) Since August 13, 2026, leaving on advance parole can also count as a departure for the 3- and 10-year unlawful presence bars (USCIS). Ask a partner-firm attorney before you travel, especially if you have ever been in the US unlawfully.
