A USCIS expedite request asks the agency to decide your case ahead of others who filed earlier. The USCIS Policy Manual says it considers all expedite requests "on a case-by-case basis in the exercise of discretion and generally requires documentation," and that "the decision to expedite is within the sole discretion of USCIS" (USCIS Policy Manual, Vol. 1, Part A, Ch. 5).
As of October 23, 2026, the Policy Manual lists five criteria, and a request that fits one of them, with evidence, has a real chance. This guide covers each criterion, the premium processing rule that rules many employment cases out, and how to submit the request.
- USCIS decides expedite requests case by case, in its sole discretion, and generally requires documentation.
- The listed criteria are severe financial loss, emergencies or urgent humanitarian situations, certain nonprofit requests, government interests, and clear USCIS error.
- Severe financial loss does not count if it results from failing to file on time or to respond to a request for evidence on time.
- The need for a work permit alone, without other compelling factors, does not warrant expedited treatment.
- If premium processing is available for a filing category, an expedite cannot be requested unless the nonprofit exception applies.
- Requests go through the USCIS Contact Center, Emma or online account secure messaging, generally after the receipt notice arrives.
- USCIS generally does not explain why it grants or denies an expedite request.
What are the USCIS expedite criteria?
The Policy Manual lists these circumstances, adding that they are examples and "not limited to" this list (USCIS Policy Manual, Vol. 1, Part A, Ch. 5, Section A):
| Criterion | What USCIS looks for |
|---|---|
| Severe financial loss | Risk to a company or person, not caused by late filing or a late response to a request for evidence |
| Emergency or urgent humanitarian situation | A pressing or critical circumstance related to human welfare |
| Nonprofit organization | An IRS-designated nonprofit whose request furthers US cultural or social interests |
| Government interests | Cases the government identifies as urgent for public interest, public safety, national interest or national security |
| Clear USCIS error | An error by USCIS that creates an urgent need to correct it |
USCIS weighs "the totality of the circumstances and evidence submitted" (same), and "not every circumstance that fits under the criteria or examples above necessarily results in expedited processing" (Section C).
What counts as severe financial loss?
A company can show severe financial loss "if it is at risk of failing, losing a critical contract, or required to lay off other employees" (USCIS Policy Manual, Vol. 1, Part A, Ch. 5). For individuals, "job loss may be sufficient to establish severe financial loss for a person, depending on the individual circumstances," and the inability to travel for work that would cause job loss "might warrant expedited treatment" (same).
Two limits matter for employment-based applicants. First, the loss cannot be self-inflicted: it does not count if it results from "the petitioner's or applicant's failure to timely file the benefit request or to timely respond to any requests for evidence" (same). Second:
"The need to obtain employment authorization, standing alone, without evidence of other compelling factors, does not warrant expedited treatment." USCIS Policy Manual, Vol. 1, Part A, Ch. 5
So a request for a delayed work permit should show the concrete consequence, such as a termination date from the employer, not just the gap. Our guide to the work permit while an I-485 is pending covers that form.
What counts as an emergency or urgent humanitarian situation?
The Policy Manual defines it as "a pressing or critical circumstance related to human welfare," and gives examples including "illness, disability, death of a family member or close friend, or extreme living conditions, such as those caused by natural catastrophes or armed conflict" (USCIS Policy Manual, Vol. 1, Part A, Ch. 5, Section A.2). It covers your own welfare and, in some cases, the welfare of others, such as expediting work permits for healthcare workers during a pandemic (same). Medical letters, hospital records or official notices make these requests credible.
Can you expedite a travel document for an emergency?
Yes, if the need is pressing. USCIS considers expediting a Form I-131 "when there is a pressing or critical need for an applicant to travel outside the United States," such as urgent medical treatment abroad or the death or grave illness of a family member or close friend (USCIS Policy Manual, Vol. 1, Part A, Ch. 5). A planned event can qualify if processing times would miss the departure date, but USCIS considers whether you filed the I-131 and answered any request for evidence on time (same). Our guide to advance parole travel explains the document itself.
Why can't you expedite most I-140 and H-1B petitions?
Because premium processing exists for them. The Policy Manual says:
"A benefit requestor cannot request expedited processing for petitions and applications where premium processing service is available for their filing category unless they meet the exception for certain nonprofit organizations." USCIS Policy Manual, Vol. 1, Part A, Ch. 5, Section B.1
The exception covers an IRS-designated nonprofit seeking a beneficiary whose services further US cultural or social interests, which may request an expedite without a fee even where premium processing is available (same). The nonprofit must show the urgency comes from "the beneficiary's specific role" in furthering those interests, not just the organization's mission (same). For everyone else, the route is Form I-907; our guide to I-140 premium processing covers the fee and timelines.
How do you submit a USCIS expedite request?
Through USCIS customer channels, after the receipt notice. USCIS says that "for most cases, you may request an expedite by contacting the USCIS Contact Center or by asking Emma," its virtual assistant, and that you generally may request one "after you receive a receipt notice" (USCIS, How to Make an Expedite Request, updated 09/08/2026). If you have a USCIS online account with secure messaging, you can select expedite as the reason, and for online-filed cases you should upload evidence there as well (same).
Expect little explanation. The Policy Manual says USCIS "generally does not provide justifications regarding expedite decisions" (USCIS Policy Manual, Vol. 1, Part A, Ch. 5, Section C). Some cases also cannot move faster even when approved for expedite, for example when biometrics, an interview, a medical exam, a pending third-party background check or a site inspection is still outstanding, or when the case depends on a principal's case (same). Your receipt number and the status pages explained in our guide to I-797 notices are what the Contact Center will ask for first.
What this means for you
An expedite is a narrow tool for a specific, documented emergency or loss.
- Match your situation to one criterion and say so plainly.
- Attach evidence: termination letters, contracts at risk, medical records, death certificates, or proof of the USCIS error.
- Make sure the urgency is not the result of a late filing or a late response.
- If premium processing exists for your form, use it rather than an expedite request.
- Have your receipt number ready, and keep a record of every request and response.
Where to start
If delays keep putting your plans at risk, a faster or more flexible category may help more than any expedite. Our free evaluation at /evaluate/ shows whether EB-1A or an NIW, both eligible for premium processing, is realistic for you, and Frank, our AI assistant at /frank, finds real opportunities for the criteria you are missing. Frequently asked questions
What are the USCIS expedite criteria?
The USCIS Policy Manual lists severe financial loss to a company or person, emergencies or urgent humanitarian situations, IRS-designated nonprofits whose request furthers US cultural or social interests, government interests such as public safety or national security, and clear USCIS error. The list is not exhaustive, USCIS weighs the totality of the circumstances, and meeting a criterion does not guarantee an expedite.
Can I expedite my I-140 or H-1B petition?
Generally not through an expedite request. The Policy Manual says a requestor cannot ask for expedited processing where premium processing is available for the filing category, unless an IRS-designated nonprofit qualifies for the cultural or social interests exception. Most I-140 and I-129 categories have premium processing, so the faster route for them is Form I-907 and the premium fee.
Will USCIS expedite my work permit if I might lose my job?
Possibly, but not on the work permit need alone. The Policy Manual says the need to obtain employment authorization, standing alone, without other compelling factors, does not warrant expedited treatment. It also says job loss may be enough to show severe financial loss for a person, depending on the circumstances. Document the specific consequence, such as a termination date or a dependent business, with evidence.
How do I submit a USCIS expedite request?
For most cases, USCIS says to contact the USCIS Contact Center or ask Emma, its virtual assistant, after you receive a receipt notice. If you have a USCIS online account with secure messaging, you can choose expedite as the inquiry reason and, for online-filed cases, upload evidence there. You will be asked about supporting documentation, so have it ready before you call.
Can I expedite advance parole for an emergency trip?
Yes, if there is a pressing or critical need to travel. The Policy Manual gives examples such as urgent medical treatment abroad or the death or grave illness of a family member or close friend. A planned event can also qualify if processing times would miss the departure date, but USCIS considers whether you filed the Form I-131 in time and responded promptly to any request for evidence.
