You're on OPT, your EAD expires next month, and your STEM OPT application is pending. Your license is tied to that EAD. Can you renew it? Can you keep driving?
As of November 2, 2026, here's how the federal rules work for students.
- F-1 students are nonimmigrants, so they qualify for a limited-term REAL ID.
- A limited-term card can't last past the authorized stay, or one year if there's no end date.
- A timely STEM OPT application extends the OPT EAD for up to 180 days.
- The extended EAD counts as unexpired only with an I-20 endorsed by the DSO recommending the extension.
- TSA's REAL ID guidance says states should accept EADs whose validity DHS has extended.
- DHS's Student and Exchange Visitor Program recommends waiting at least 10 days after arrival to apply for a license.
Can F-1 and OPT students get a license?
Yes, a limited-term one. The REAL ID regulation covers anyone who "has a valid nonimmigrant status in the United States" (6 CFR 37.3, eCFR), and F-1 is a nonimmigrant status. States may not issue that card "for a time period longer than the expiration of the applicant's authorized stay in the United States, or, if there is no expiration date, for a period longer than one year" (6 CFR 37.21, eCFR).
If your I-94 shows no fixed end date, the one-year limit is the one that applies. On OPT, an "Unexpired employment authorization document (EAD) issued by DHS, Form I-766" is an accepted identity document (6 CFR 37.11(c)). Our guide to REAL ID on H-1B, H-4 or an EAD covers the general rules.
How does a pending STEM OPT application help?
It extends your EAD. The regulation says a student whose STEM OPT application was timely filed and is pending, and whose OPT EAD has expired, is authorized to work from the old EAD's expiry "ending on the date of USCIS' written decision on the current Form I-765 or successor form, but not to exceed 180 days" (8 CFR 274a.12(b)(6)(iv), eCFR).
The key condition is the I-20. "For this same period, such Form I-766 or successor form is automatically extended and is considered unexpired when combined with a Certificate of Eligibility for Nonimmigrant (F-1/M-1) Students, Form I-20 or successor form, endorsed by the Designated School Official recommending such an extension."
- Your expired OPT EAD.
- Your I-20 endorsed by your DSO recommending the STEM OPT extension.
- The I-797 receipt notice for your STEM OPT application.
TSA's REAL ID guidance says states "should accept DHS-issued EADs that have had the validity period automatically extended by DHS because they are unexpired," and that states should "use SAVE to verify the extended EAD validity period" (TSA, REAL ID Frequently Asked Questions). Our guide to STEM OPT rules explains eligibility. If you're on post-completion OPT and between jobs, our guide to OPT unemployment days explains the limits.
What about cap-gap?
It's a separate extension. The regulation also covers a student who "is seeking H-1B nonimmigrant status and whose status and employment authorization have been extended pursuant to 8 CFR 214.2(f)(5)(vii)" (8 CFR 274a.12(b)(6)(v)). Our guide to the H-1B cap-gap extension explains it. Bring your H-1B receipt and a cap-gap I-20, and ask your DMV how it handles that combination.
What if the DMV can't verify your status?
Use CaseCheck and push back. USCIS says most SAVE checks finish within seconds, but some "may require additional processing times, which vary," and you can track yours with SAVE CaseCheck using your date of birth and an identifier such as your SEVIS ID or receipt number (USCIS, SAVE CaseCheck).
If you're denied based on SAVE, the agency "must give you information about their appeal process" (USCIS, Records Fast Facts for Benefit Applicants). For SEVIS record problems, USCIS points students to their DSO first.
When should new students apply?
After about 10 days. The SAVE fact sheet for students says DHS's Student and Exchange Visitor Program recommends waiting at least 10 calendar days after arriving before applying for a driver's license or state ID (USCIS, SAVE Fact Sheet for Students). Frequently asked questions
Can I get a driver's license on OPT?
Yes. As an F-1 nonimmigrant, you're in temporary lawful status under the REAL ID rules, so you can get a limited-term REAL ID. Your EAD is an accepted identity document. The card can't outlast your authorized stay, or one year if your stay has no end date, and the DMV verifies your status through SAVE.
Can I renew my license while my STEM OPT is pending?
Often, yes. If your STEM OPT application was filed on time and your original OPT EAD has expired, the regulation extends that EAD for up to 180 days when combined with an I-20 endorsed by your DSO recommending the extension. TSA's REAL ID guidance tells states to accept EADs extended by DHS. Bring the EAD, endorsed I-20 and receipt.
Does the 180-day STEM OPT extension work for the DMV?
It should, if you present the right combination. The regulation says the expired EAD is automatically extended and considered unexpired when combined with an I-20 endorsed by the DSO. States check status through SAVE, which can take longer for pending cases. If the DMV can't verify, use SAVE CaseCheck and ask about its appeal process.
What if I'm on cap-gap waiting for H-1B?
The regulation separately covers F-1 students seeking H-1B whose status and employment authorization are extended under the cap-gap rule. Bring your H-1B receipt notice and an I-20 updated by your DSO for the cap-gap period. Whether your DMV issues a card on that basis is a state decision, so ask before your current card expires.
How soon after arriving can a new F-1 student apply for a license?
The SAVE fact sheet for students says DHS's Student and Exchange Visitor Program recommends waiting at least 10 calendar days after arriving in the US before applying for a driver's license or state ID.
