Driver's license expires with your I-94? What to do during an H-1B extension

If you are on H-1B, H-4 or another temporary status, a REAL ID license cannot last longer than your authorized stay, so it usually expires on your I-94 date. As of November 2, 2026, federal rules require the DMV to check your status through the USCIS SAVE system and to renew a limited-term card only in person, with proof that your status is still in effect. If your extension is pending, bring the receipt notice and your current documents, and expect the DMV's check to take longer than usual.

You open your wallet and notice that your license expires next month, on the same day as your I-94. Your H-1B extension is filed, but the approval hasn't come. Can you still drive? Can you renew?

As of November 2, 2026, this guide explains why your license is tied to your stay, how renewal works while an extension is pending, and how to avoid a gap.

Key facts
  • A limited-term REAL ID cannot last longer than your authorized stay in the United States.
  • If there is no end date on your stay, the limit is one year.
  • Limited-term cards must say they are temporary or limited term on the front.
  • Limited-term cards must be renewed in person, not online.
  • DMVs check your status through USCIS's SAVE system.
  • SAVE CaseCheck lets you track the DMV's status check online.

Why does an H-1B driver's license expire with the I-94?

Because federal law caps it. Under the REAL ID regulation, states may only issue a temporary or limited-term REAL ID "to an individual who has temporary lawful status in the United States," and may not issue it "for a time period longer than the expiration of the applicant's authorized stay in the United States, or, if there is no expiration date, for a period longer than one year" (6 CFR 37.21, eCFR).

Temporary lawful status covers anyone who "has a valid nonimmigrant status in the United States," which includes H-1B and H-4, and also people who have "a pending application for LPR or conditional permanent resident status" (6 CFR 37.3, eCFR).

The card must also say so. Limited-term cards "must clearly indicate on the face of the license and in the machine readable zone that the license or card is a temporary or limited-term driver's license or identification card" (6 CFR 37.21).

Your situationWhat the rule allows
H-1B or H-4 with an I-94 end dateA limited-term card up to that date, or the state's maximum, whichever is shorter
Status with no end dateUp to one year
Pending green card applicationA limited-term card
Green card holderA full-term card

Can you renew a license online on H-1B?

Not a limited-term REAL ID. The TSA's REAL ID FAQ says temporary or limited-term licenses "need to be renewed in person and upon presentation and verification of valid documentary evidence that the temporary lawful status is still in effect or that the individual has lawful status in the United States" (TSA, REAL ID Frequently Asked Questions).

The regulation adds that holders of limited-term cards "must present evidence of continued lawful status via SAVE or other method approved by DHS when renewing" (6 CFR 37.25, eCFR). So plan for an office visit, and book it early.

These rules apply to REAL ID cards. Some states also issue standard licenses that are not REAL ID compliant. Those follow your state's own rules, so read your DMV's page for nonimmigrants before you go. Our guide to REAL ID on H-1B, H-4 or an EAD covers which documents count and whether you need one to fly.

How does renewal work while your H-1B extension is pending?

This is where most problems happen. The DMV has to see that your status continues, and it checks through SAVE, a USCIS service that government agencies use "to verify immigration status and U.S. citizenship of applicants seeking benefits or licenses" (USCIS, SAVE).

SAVE gives the DMV information. It does not decide. USCIS says "SAVE does not determine your eligibility; only the agency issuing the benefit or license makes that determination" (USCIS, SAVE for Benefit and License Applicants).

What to bring
  • Your passport, with your current visa if you have one.
  • Your most recent I-94, printed from CBP's I-94 website.
  • Your current I-797 approval notice.
  • The I-797 receipt notice for the pending extension.
  • Your Social Security card or number, and two proofs of address.

USCIS's own tip is to "include the most recently issued document as part of your benefit or license application." If the extension was filed on time, the regulation lets you keep working for the same employer "for a period not to exceed 240 days" after your stay expires while it is pending (8 CFR 274a.12(b)(20), eCFR). Whether your state's DMV will issue a new card on the receipt alone is a state decision, so ask before your current card expires.

Our guide to H-1B extensions explains how the filing works, and our guide to an expired visa with a valid I-94 explains which date controls your stay.

What if the DMV says it can't verify your status?

Use CaseCheck, then go back. USCIS says most SAVE cases are verified within seconds, but some "may require additional processing times, which vary." With SAVE CaseCheck, you can track a case using your date of birth and an identifier such as your I-94 number, receipt number or A-Number (USCIS, SAVE CaseCheck).

If the response is a denial, you have rights. "If you are denied a benefit based on a SAVE response, the agency must give you information about their appeal process and allow you to contact the Federal government to correct your information prior to a final decision" (USCIS, Records Fast Facts for Benefit Applicants).

SAVE matches your name, date of birth and a document number, so check that they agree across your documents and that your I-94 reflects your latest approval. Fix the record at the agency that issued it. CBP handles I-94 errors, and USCIS handles errors on its notices. SAVE itself "cannot issue, correct, renew, or replace your records or documents."

How do you avoid a gap?

Start early, and line up your dates. Once the extension approval arrives, take the new approval notice to the DMV well before your card expires.

Your checklist
  • Check your license and I-94 dates side by side today.
  • Ask your employer when the extension will be filed, and whether premium processing is planned.
  • Book the DMV appointment as soon as the approval arrives.
  • If your card will expire first, call your DMV and ask what it accepts.
  • Don't drive on an expired license while you wait.

What changes once you have a green card?

The I-94 link ends. The TSA's FAQ says "noncitizens lawfully admitted for permanent or temporary residence" are "eligible for a full-term REAL ID license or identification card" (TSA, REAL ID Frequently Asked Questions). It also says anyone with a limited-term card "can reapply for a regular full term REAL ID at any time if their status changes." While the green card is still pending, you remain in the limited-term group. Our guide to what happens after I-485 approval covers the documents you can show in the meantime. What this means for you

Your checklist
  • On H-1B or H-4, your REAL ID license is capped at your authorized stay.
  • Plan an in-person renewal, with your newest documents.
  • A pending extension can slow the DMV's SAVE check, so start early.
  • Use SAVE CaseCheck if the DMV can't confirm your status.
  • A green card makes you eligible for a full-term license.

Frequently asked questions

Why does my driver's license expire on the same day as my I-94?

Because federal REAL ID rules say a temporary or limited-term license cannot be issued for longer than your authorized stay. For H-1B and H-4 holders, the authorized stay is usually the date on the I-94. If there is no end date, the limit is one year. A state can also set a shorter term under its own rules.

Can I renew my driver's license while my H-1B extension is pending?

You can apply, but the DMV must see proof that your status continues and must verify it through SAVE. Bring your I-797 receipt notice for the extension, your current approval notice, passport and I-94. A pending case can take longer to verify. If the DMV can't confirm your status, ask how its appeal or correction process works.

Can H-1B holders renew a driver's license online?

Not for a REAL ID limited-term card. Federal rules say temporary or limited-term REAL ID licenses must be renewed in person, with proof that your lawful status is still in effect. Some states issue standard licenses that are not REAL ID, which follow the state's own rules, so check your DMV's website first.

What does SAVE do in a driver's license application?

SAVE is a USCIS service that government agencies use to verify immigration status. The DMV sends your details and gets a response. SAVE does not decide whether you get a license; the DMV does. Most cases come back within seconds, but some need extra checks, and you can track yours online with SAVE CaseCheck.

Will my license be valid longer once I get a green card?

Yes. DHS says noncitizens lawfully admitted for permanent residence are eligible for a full-term REAL ID license, not a limited-term one. Once your green card is approved, you can apply again with your card or temporary I-551 evidence, and the license should no longer be tied to an I-94 date.
