An EB-2 to EB-3 downgrade means your employer files a second Form I-140 for you in the EB-3 professional or skilled worker category, using the same PERM labor certification it already used for your EB-2 petition. USCIS allows a new I-140 to rely on an original labor certification that was "submitted with another Form I-140" during its validity period (USCIS, I-140 Filing and Processing Procedures). If your EB-2 petition is approved, you keep its priority date for the EB-3 petition (8 CFR 204.5(e)).
As of October 21, 2026, the payoff for Indian applicants is small. India's EB-2 and EB-3 Dates for Filing are both January 15, 2015 (USCIS, When to File: October 2026), and that is the chart USCIS says employment-based applicants must use this month (USCIS, Adjustment of Status Filing Charts). The strategy matters when EB-3 India moves ahead of EB-2 India, and it has backfired before when EB-3 moved back.
- A downgrade is a new Form I-140 in EB-3, filed by the same employer with the same PERM labor certification already used for the EB-2 petition.
- USCIS requires a separate Form I-140, with its own fee, for each visa category requested for a beneficiary.
- Under 8 CFR 204.5(e), an approved EB-1, EB-2 or EB-3 petition gives its priority date to later petitions in those categories, unless revoked for fraud, error or an invalid labor certification.
- In the October 2026 Dates for Filing chart, India's EB-2 and EB-3 dates are both January 15, 2015.
- India's EB-3 Dates for Filing date fell from January 1, 2015 in October 2020 to July 1, 2012 in October 2022.
- Moving a pending I-485 to the EB-3 petition requires a written transfer request, and once granted, the EB-2 petition no longer supports the I-485.
- EB-3 always requires a labor certification, so an EB-2 NIW approval cannot be downgraded on its own.
What is an EB-2 to EB-3 downgrade?
EB-2 covers people of exceptional ability and members of the professions holding an advanced degree, defined as a degree above a bachelor's, or a bachelor's followed by at least five years of progressive experience in the specialty (8 CFR 204.5(k)(2)). EB-3 covers professionals with at least a bachelor's degree, skilled workers with at least two years of training or experience, and other workers (8 CFR 204.5(l)(2)). A job that qualified for EB-2 usually also meets the EB-3 definitions, which is why the same PERM can support both.
The two categories have separate annual limits. Each gets up to 28.6 percent of the worldwide employment-based level, plus numbers unused by the categories above it (8 U.S.C. 1153(b)). Natives of a single country are generally limited to 7 percent of the family and employment preference visas available in a year (8 U.S.C. 1152(a)(2)). India has its own cutoff dates in both categories on the USCIS filing chart (USCIS, When to File: October 2026), and the two India queues do not always move together, as the table below shows.
A downgrade does not convert your EB-2 approval. USCIS says it "cannot change the visa category" once it has decided an I-140, and that each requested category needs its own petition, fee and supporting documents (USCIS, I-140 Filing and Processing Procedures). You end up with two petitions, and that is the point: you can use whichever one is ahead.
Can I reuse my PERM labor certification for the EB-3 I-140?
Yes, in the usual case. A labor certification normally expires if it is not filed with an I-140 within 180 calendar days of certification (20 CFR 656.30(b)(1)). Once it has been filed in time with the EB-2 petition, USCIS gives this instruction for a later petition:
"If you are filing a new or amended Form I-140 and you already submitted the original labor certification with another Form I-140 during its validity period, check the box marked “Yes” at Part 4, Item 9 of the form." USCIS, Petition Filing and Processing Procedures for Form I-140 (last updated 02/18/2026)
Three conditions come with the reuse. The labor certification is valid only for the particular job opportunity, the person named on it, and the area of intended employment (20 CFR 656.30(c)(2)). For the professional subcategory, the job offer in the labor certification must require at least a bachelor's degree (8 CFR 204.5(l)(3)(i)). And the employer must show it can pay the offered wage from the priority date until you become a permanent resident (8 CFR 204.5(g)(2)).
Do I keep my priority date when I downgrade?
Yes, if the EB-2 petition is approved. The regulation is direct:
"A petition approved on behalf of an alien under sections 203(b)(1), (2), or (3) of the Act accords the alien the priority date of the approved petition for any subsequently filed petition for any classification under section 203(b)(1), (2), or (3) of the Act for which the alien may qualify." 8 CFR 204.5(e)(1)
With more than one approved petition, you are entitled to the earliest priority date (8 CFR 204.5(e)(1)). The date is lost only if USCIS revokes the approval for fraud or willful misrepresentation, a revoked or invalidated labor certification, or a material error (8 CFR 204.5(e)(2)). We go through these rules in more detail in priority date retention.
With the same PERM, the date usually matches anyway. The priority date of a petition filed with an individual labor certification is the date the Department of Labor accepted the labor certification application for processing (8 CFR 204.5(d)).
An employer withdrawal does not undo this once enough time has passed. A petition withdrawn 180 days or more after approval, or 180 days or more after the related I-485 was filed, "remains approved unless its approval is revoked on other grounds" (8 CFR 205.1(a)(3)(iii)(C)). Our guide to what can revoke an approved I-140 covers the exceptions.
Is EB-3 India ahead of EB-2 India in October 2026?
Barely. On the Dates for Filing chart, which governs when you can submit an I-485 this month, India's EB-2 and EB-3 dates are identical at January 15, 2015 (USCIS, When to File: October 2026). On the Final Action Dates chart, which controls approval, a September 30, 2026 Ogletree Deakins summary of the bulletin reports India EB-2 at November 1, 2013, returning from "unavailable," and India EB-3 unchanged at January 1, 2014 (Ogletree Deakins, October 2026 Visa Bulletin). On those figures, only priority dates in November and December 2013 are approvable in EB-3 but not in EB-2 this month.
The gap has been much wider. These are India's Dates for Filing in each October chart, as published by USCIS:
| October chart | EB-2 India | EB-3 India |
|---|---|---|
| 2020 (USCIS) | May 15, 2011 | January 1, 2015 |
| 2021 (USCIS) | July 8, 2012 | January 8, 2014 |
| 2022 (USCIS) | May 1, 2012 | July 1, 2012 |
| 2023 (USCIS) | May 15, 2012 | August 1, 2012 |
| 2024 (USCIS) | January 1, 2013 | June 8, 2013 |
| 2025 (USCIS) | December 1, 2013 | August 15, 2014 |
| 2026 (USCIS) | January 15, 2015 | January 15, 2015 |
In October 2020, EB-3 India was more than three and a half years ahead of EB-2 India on this chart. By October 2022 the lead was two months, and the EB-3 India date itself had moved back from 2015 to 2012. USCIS also picks the chart each month, and on October 21, 2026 its November choice was listed as "Coming soon" (USCIS, Adjustment of Status Filing Charts). For the wider India picture, see our October 2026 Visa Bulletin breakdown and EB-1A and EB-2 NIW wait times for Indians.
The queues behind those dates differ in size: USCIS counts 356,360 approved EB-2 petitions and 106,214 approved EB-3 professional and skilled worker petitions for India-born principals awaiting a visa as of June 2026, and notes the counts can include more than one petition for the same person (USCIS, Approved EB Petitions Awaiting Visa Availability, June 2026).
How does interfiling move a pending I-485 to the EB-3 petition?
"Interfiling" is the informal name for what USCIS calls a transfer of underlying basis. USCIS's examples include an applicant with a pending I-485 who later has an employment-based petition filed in a different preference category (USCIS Policy Manual, Vol. 7, Part A, Ch. 8).
The core rules from that chapter:
- Written request. You must ask in writing; no new I-485 or filing fee is generally required (USCIS Policy Manual, Vol. 7, Part A, Ch. 8).
- Visa available that day. The priority date must be current for the new category, and the date the transfer request is filed is the one that counts (USCIS Policy Manual, Vol. 7, Part A, Ch. 8).
- Pending or approved petition. You can transfer to an approved petition, or to a pending one if the new category allows concurrent filing (USCIS Policy Manual, Vol. 7, Part A, Ch. 8).
- Discretion. Every transfer is discretionary, but USCIS singles out "simple transfers between the first three employment-based categories" as the exception to its warning that requests should not be assumed to be granted (USCIS Policy Manual, Vol. 7, Part A, Ch. 8).
- Supplement J. An applicant transferring to a different I-140 "may sometimes be required" to submit Form I-485 Supplement J, and a Supplement J for a transfer request should not be filed online (USCIS, Form I-485 Supplement J).
- Timing. USCIS must deny a transfer request received on or after the date the I-485 is finally decided (USCIS Policy Manual, Vol. 7, Part A, Ch. 8).
If you have not filed an I-485 yet, there is nothing to transfer.
When does an EB-2 to EB-3 downgrade backfire?
EB-3 retrogresses. The table above shows how fast a lead can disappear. Someone who started a downgrade in late 2020 for an EB-3 filing window could find that by October 2022 the EB-3 India date had moved back to July 1, 2012 (USCIS, When to File: October 2022).
The transfer cuts the EB-2 link. USCIS is explicit:
"Once an applicant makes a request to transfer a pending adjustment application from one basis to another and if the transfer request is granted, the original petition no longer supports the adjustment application. This rule applies even if the original petition is approved." USCIS Policy Manual, Volume 7, Part A, Chapter 8
After a transfer to a pending EB-3 petition, that petition alone supports the I-485, and any replacement petition must be properly filed and designated before the supporting petition is withdrawn, denied or revoked (USCIS Policy Manual, Vol. 7, Part A, Ch. 8). Whether to transfer before or after EB-3 approval is a question for your attorney.
Moving back has the same conditions. If EB-2 later overtakes EB-3, a beneficiary with an approved petition and a pending I-485 can replace it with a different approved petition (USCIS Policy Manual, Vol. 7, Part A, Ch. 8).
The new petition is a full petition. The EB-3 I-140 needs its own fee and supporting documents (USCIS, I-140 Filing and Processing Procedures), and ability to pay is judged again from the priority date onward (8 CFR 204.5(g)(2)). Since August 5, 2026, USCIS may deny a filing without first issuing a Request for Evidence or Notice of Intent to Deny when it does not show eligibility (USCIS alert, August 5, 2026).
You have changed employers. Only a US employer "desiring and intending to employ" you can file an EB-2 or EB-3 petition (8 CFR 204.5(c)), and the PERM is valid only for the job it describes (20 CFR 656.30(c)(2)). If you have moved to a new job under AC21 portability, the old employer's PERM may not support a new EB-3 petition, and the USCIS Policy Manual notes that portability itself does not require a transfer request (USCIS Policy Manual, Vol. 7, Part A, Ch. 8).
Your green card is an NIW. Every EB-3 petition must come with an individual labor certification, a Schedule A application or shortage occupation evidence (8 CFR 204.5(l)(3)(i)). An NIW approval has no PERM to reuse, so an EB-3 option means a new PERM, though an approved NIW priority date would carry over (8 CFR 204.5(e)(1)).
Is EB-3 a better long-term bet for Indian applicants?
Nobody can say. In an August 2026 policy brief, the National Foundation for American Policy projected potential waits of 179 years in EB-2 and 38 years in EB-3 for an India-born applicant filing in January 2026 or later (NFAP, August 2026). The same brief estimates that the India EB-3 backlog grew 51.1 percent between April 2020 and December 2025, to about 213,414 people (NFAP, Table 4). These are think-tank projections, not official waits.
What this means for you
A downgrade is useful insurance only when your employer will file it, your PERM job meets the EB-3 definition, and your EB-2 petition is approved so the priority date is protected. It is most useful when EB-3 India is ahead of EB-2 India on the chart USCIS designates, and in October 2026 that is not the case for filing.
- Confirm your EB-2 I-140 is approved, not just pending, before relying on priority date retention.
- Check that the PERM job requires at least a bachelor's degree, or two years of training or experience.
- Confirm you still work for, or will work for, the employer that holds the PERM.
- Compare EB-2 and EB-3 India on both charts every month.
- Keep the approved EB-2 I-140 in place, so you can move back if the dates flip.
- Ask your attorney when to file the transfer request, and whether to wait for EB-3 approval first.

Frequently asked questions
Do I lose my EB-2 priority date if I downgrade to EB-3?
Generally no. If your EB-2 I-140 is approved, 8 CFR 204.5(e) gives its priority date to any later EB-1, EB-2 or EB-3 petition you qualify for, unless USCIS revokes the approval for fraud, material error or a revoked or invalidated labor certification. When the EB-3 petition uses the same PERM, its own priority date is also the date the Department of Labor accepted that PERM application, so the date matches either way.
Does my employer need a new PERM for an EB-2 to EB-3 downgrade?
Usually not. USCIS lets an employer file a new or amended Form I-140 without the original labor certification if that original was already submitted with another I-140 during its validity period, by checking Part 4, Item 9 and flagging it on a cover sheet. The employer still files and pays for a separate I-140, and the job described in the PERM must meet the EB-3 professional or skilled worker definition.
Is the EB-2 to EB-3 downgrade worth it for Indians in October 2026?
For most people, it adds little this month. India's EB-2 and EB-3 Dates for Filing are both January 15, 2015, which is the chart USCIS designated for employment-based filings in October 2026. A September 2026 law firm summary put the final action dates at November 1, 2013 for EB-2 and January 1, 2014 for EB-3, so only priority dates in November and December 2013 gain on approval.
Can I go back to EB-2 after downgrading to EB-3?
Often yes, if you kept the approved EB-2 I-140. The USCIS Policy Manual allows a pending I-485 to be transferred from one approved petition to another, and you are entitled to the earliest priority date among multiple approved petitions. Each transfer is a written, discretionary request, and the new category must have a visa immediately available on the date the request is filed. Your attorney can confirm the timing before you ask.
Can I downgrade from an EB-2 NIW to EB-3?
Not with the NIW petition alone. Every EB-3 petition must be accompanied by an individual labor certification, a Schedule A application or qualifying shortage occupation evidence, and the NIW waives the labor certification. An NIW beneficiary who wants an EB-3 option needs an employer to complete PERM and file an EB-3 I-140. An approved NIW priority date would still carry over to that later petition under 8 CFR 204.5(e).
